In the increasingly litigious climate of the United States Today, everyone is being held to higher standards of conduct. Owners, managers, and co-workers must keep pace with laws that change continually and must be sensitive to the ever-growing list of protected classes and groups of people.

In the continuing effort to keep our clients informed of available insurance products, the Karsanidi Group is pleased to announce the availability of a new coverage designed to protect exposures in this area of EMPLOYMENT PRACTICES LIABILITY.

This innovative Policy contains many broad features that could respond to allegations of wrong doing in such areas as:

Employment Practices, including:

  • Discrimination

  • Sexual Harassment

  • Other Workplace Harassment

  • Wrongful Termination

  • Employment Misrepresentation

  • Failure to Promote

  • Negligent Employee Evaluation

Liability Imposed by the Following:

  • Americans with Disabilities Act (ADA)

  • Civil Rights Act of 1991

  • Rehabilitation Act of 1973

  • Pregnancy Discrimination Act of 1978

  • Federal Age Discrimination in Employment Act

  • Violation of the Whistleblower Act

  • Libel/Slander/Defamation

  • Mental Anguish

  • Back and Future Wages

This program is available to all classes of For-Profit employers (except Law Firms) up to a combination of 150 Full-Time and Part-Time employees (Part-Time, Seasonal and Temporary count as half).  An Employee Manual is preferred, but not mandatory.  Available in all states, except: AZ, CA.

The carrier is St. Paul Insurance and the standard commission is 10%.  There is a $50 policy fee for premiums under $1,500. 

 

Reasons to Buy:

This policy form offers the coverage needed to minimize the insured's exposure from claims brought by its employee's and includes the following features:

A Duty to Defend Clause which provides the insured with knowledgeable, experienced legal representation as soon as a covered claim is presented.  This defense will be provided even if the allegations of the claim are groundless , false or fraudulent.

The policy contains a broad definition of "Claim" including any written notice received by any insured intending to hold them responsible for a Wrongful Employment Practice.  The definition of claim also includes any judicial, administrative or arbitration proceeding initiated against an insured seeking to hold such insured responsible for a Wrongful Employment Practice.

Entity and Employee coverage is provided/  Coverage is extended to the company and its directors, officers, owners, members or partners and also includes their spouses for conduct within the scope of their duties for the company.  Additionally, coverage for claims against employees, including any Part-Time, Seasonal and Temporary for conduct within the scope of their duties for the company is also provided.

Policy Highlights:

  • Duty to defend policy provides the insured with knowledgeable, experienced legal representation

  • Broad claim definition covers more than just lawsuits; also provides coverage for any written notice received by an insured intending to hold them responsible for a wrongful act; including judicial or administrative proceedings

  • Entity and employee coverage covers the company and its directors, officers, owners, partners or their spouses. Also provides coverage for any employee while acting within the scope of his/her duties.

  • Loss prevention handbook

Eligible Risks:

  • Firms with 100 or fewer employees. Excluded classes include law firms, financial institutions, or temporary agencies/employment firms.

Wrongful Employment Practices:

  • Wrongful termination claims covers a claim brought by a former employee that he or she was wrongfully terminated. Also covers claims of constructive discharge.

  • Discrimination claims covers claims by employees who charge that they were the victim of discrimination: race, color, creed, national origin, gender, military service, pregnancy, sexual orientation, marital status, religion, age, disability, and/or handicap

  • Sexual harassment covers claims by employees against supervisors and fellow employees

  • Retaliation covers claims by employees who charge that they were the subject of an adverse employment decision because they exercised any legally protected right

  • Other wrongful employment practices related claims covers other employment related allegations such as: libel, slander, defamation, invasion of privacy, mental anguish, emotional distress, assault, battery, and much more.
